Your One Way Ticket To First Class FMLA Leave Management & Administration: A Case Study Nose Dive

Learning Objectives

1. How to simplify FMLA leave administration and maintain workplace productivity;

2. Review steps that must be taken by employers when properly administering FMLA leave and communicating with employees and health care professionals; and,

3. How to tackle some of the most complex leave management issues.


During this session, we will deconstruct the sometimes confusing web of employer obligations under the FMLA, from the initial leave or accommodation request all the way through recertification. By using real life case studies, we will walk through the required forms, conversations and follow through and will demonstrate each step that must be taken by employers when properly administering FMLA leave and communicating with employees and health care professionals. In addition, during this session, we will cover:

  • What circumstances qualify for leave under the FMLA;
  • Notice and posting requirements;
  • Evaluating certification paperwork;
  • Designating leave as FMLA;
  • Leave management for intermittent and continuous period leaves of absence;
  • Recertification;
  • Tracking and calculating continuous period and intermittent leave use;
  • Substitution of paid leave and maintenance of benefits;
  • Recognizing employee statements that should trigger HR involvement and the interaction between the ADA and FMLA with leave management;
  • What impact recent FMLA court decisions will have on employers in 2018; and
  • Special issues.

Whether you are responsible for FMLA leave administration within your organization or you advise others on that process, this session is your crash course on the fundamentals of FMLA leave administration and will help you tackle some of the most complex leave management issues.


Jaime is involved in all aspects of the employment defense practice at Kastner Westman & Wilkins LLC, including employment litigation, workers' compensation and traditional labor. Jaime advises private and public sector employers on employee relations matters, assists employers in responding to administrative charges before state administrative agencies and represents employers at administrative hearings and in arbitrations.

Jaime also works with employers on workplace policies and procedures, frequently presents on various HR topics and conducts on-site employee and supervisory level training. Jaime strives to keep employers apprised of key developments in federal and state labor and employment laws.
